Membership Terms & Conditions

These terms and conditions form the basis of the contract through which the International Associationof Certified Compliance Specialists (IACCS) (we or us) will deliver a service to you as anIACCS member (you). On becoming a member of IACCS you are automatically agreeing to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with any relevant data protection laws.The IACCS is the pre-eminent professional body for compliance professionals. Individuals gain membership in the IACCS and designation as a Certified Compliance Specialist (CCS) through the IACCS examination process and/or practical experience.

Membership Benefits

Membership in the IACCS will provide you with membership Member, Founding Member, Corporate Partner or Certified Compliance Specialist. As anIACCS member you will receive a wide range of benefits. Membership packages may vary according to the grade of membership held. We reserve the right to change the benefits that apply to IACCS membership at any time and without prior notice. Any external providers of a benefit included within your membership package will have absolute discretion in relation to the provision of services, and membership of IACCS does not guarantee that the external provider will accept an application from a member for the provision of services. Services supplied from an external provider will be subject to the provider’s own terms and conditions, and we do not accept any liability for loss or damage suffered as a result of a fault, error or omission in the provision of these services. We reserve the right to change our external providers without prior notice and our decision on services provided is final.

The Membership Contract

When you click to submit your application on line, or you fax, post, telephone or e mail us with details of your application, you are making an offer to subscribe to the IACCS which, if accepted by us, will result in a legally binding contract. At the point of renewal of your membership, your renewal payment is confirmation of the continued acceptance of this contract. You may not transfer any of your rights and obligations under these terms and conditions to another person.

On Line application

For on line applications you will either have sight of a confirmation page or receive an email. If you have supplied your email address, acknowledgement that your application has been received and is being processed does not yet mean that the contract between us is formed. A legally binding contract is formed on the date we send your welcome pack. This will be sent out when all of your documents have been received and assessed, and membership level is confirmed.

Written/verbal Application

For applications made verbally or via a written application form or e mail; the contract between us will be formed when we send your welcome pack. This will be sent out when all of your documents have been received and assessed, and membership level is confirmed.

Professional Development and Conduct

By proceeding with this application you are confirming that, as a member of the IACCS, you will be committed to the development of others and that you intend to develop your compliance skills and professionalism continuously. You are also agreeing to abide by the IACCS’ sCode of Ethics and Professional Standards.All members sign up to this Code on joining, and reaffirm their commitment on an annual basis. Failure to adhere to the code, resulting in a formal complaint made against you, may result in a disciplinary procedure being implemented.

 

Terms of Service

These Terms of Service (“TOS”) apply to you (“the Member”) if youhave ordered/purchased any membership services, course curriculum, or examination fees (the “Services”) from the International Association of Certified Compliance Specialists (IACCS). This TOS supersedes any other written or oral policy and defines the terms that all IACCS members agree to when purchasing any services provided by IACCS. IACCS reserves the exclusive right to change, amend or revise any portion of this TOS at any time,with or without written notice to our members. Members using any services offered by IACCS agree to be obligatedby and must comply with all policies in this TOS or must cancel their Services with IACCS. IACCS reserves the right to discontinue Services to any member at our sole discretion and may take action against any member deemed by IACCS to be in violation of this TOS including the cancellation of any services without refund and/or, if deemed appropriate, with legal action.

Conduct:

Any abuse of our staff in any medium or format will result in account termination without refund.

Payment Obligations:

Full payment is required in advance before membership services and course participation is established. IACCS sends out invoices that are due every pay period and payable upon receipt. You warrant and represent that theinformation you supply when purchasing services from IACCS (or other information that IACCS may require) is accurate and truthful. All payment-due notices will be sent by e-mail. No bills or invoices will be sent by postal mail or fax. If payment was not received by the due-date, your membership may be suspended. It is your responsibility toensure that payment is made to IACCS prior to the renewal date and although IACCS sends renewal notices to our customers prior to their renewal date, because of the ability for a customer to change their contact email addresses without notifying IACCS, the customer is ultimately responsible for remembering their renewal date and to make sure payment is made upon the renewal. Customer further represents and warrants that it has the authority to enter into this agreement.

Acceleration Clause:

In the event of the debtor defaulting in any single installment, the creditor hasthe right to proceed against the debtor for the full balance of the debt outstanding.

Renewals:

You are responsible to ensure your renewal fees are received prior to the expiration of your membership. If your annual fees are not received by your renewal date, your membership will be cancelled and you will no longer be deemed to hold the CCS designation.

Disclaimer of Warranty:

IACCS makes no express or implied warranties, including without limitation, implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. IACCS further makes no warranties or representations about the accuracy or completeness of the site’s content and does not endorse any user content posted on the site. IACCS assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of any content; (ii) personal injury or property damage of any nature whatever resulting from your access to and use of the site; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein; (iv) any interruption or cessation of transmission to or from the site; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the site by any third party; and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the site. IACCS does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site or any hyperlinked site, or featured in any banner or other advertising, and IACCS will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.NeitherIACCS nor anyone else involved in the provision of Service isliable to you, the customer, or any third-party for direct or indirectdamages resulting from the use, non-use of services provided herein,whether or not such damages resulted from the negligence of IACCS,even if IACCS has been advised to the possibility of such damages.

Limitation of Liability

Under no circumstances will IACCS or its affiliates be liable to any user for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this code of conduct or your use of the site. You specifically acknowledge that IACCS shall not be liable for user content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

Indemnification:

You agree to defend, indemnify and hold harmless IACCS, its shareholders, officers, directors, members, affiliates, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the site; (ii) your violation of any term of this code of conduct; (iii) your violation of any third party right, including without limitation any copyright, trademark, property, or privacy right; or (iv) any claim that one of your comments caused damage to a third party. The foregoing indemnification obligation will survive this code of conduct and your use of the site.

Governing Law and Jurisdiction

This Agreement shall be interpreted under the laws of the Cayman Islands without regard to any conflict of law’s provisions. Anyaction between the parties to this agreement for the breach of thisagreement or any action or claim in any way relating thereto shall bevenued in the Summary Court of the Cayman Islands. The parties to this agreement hereby consent to jurisdiction inthat court and agree to accept service by mail and hereby waive anydefense of any kind related to jurisdiction or venue.

Cancellation & Refunds:

IACCS does not allow for the refund of membership purchases unless there are exceptional circumstances. Where exceptional circumstances can be shown to exist, the pro rata amount of the membership fee not exceeding 6 months may be refunded at the discretion of the Membership Chair. You may cancel your IACCS membership at any time; however IACCS does not provide refunds or credits for any partial-year subscription periods. Refunds on course materials once delivered are not eligible for refunds or credits. You must contact customer service by emailinginfo@IACCS.com. Refunds of any kind are not available to any customer violating thisTOS.

IACCS Brand

Use of our logo by you is not permitted unless you are an approved partner of the IACCS, and we have granted you express permission.

Queries Comments and Complaints

We will respond to any complaint or query received within three working days. This may be an acknowledgement that we have received a complaint whilst further investigations are carried out.
